37 CFR 1.48(f) specifically provides that any request to correct or update the name of the inventor or a joint inventor, or the order of the names of joint inventors, in a nonprovisional application must include:
(1) an application data sheet in accordance with 37 CFR 1.76 that identifies each inventor by his or her legal name in the desired order (identifying the information that is being changed as required by 37 CFR 1.76(c)(2)); and (2) the processing fee set forth in 37 CFR 1.17(i). - MPEP 602.01
where an application is filed with an application data sheet correctly setting forth the residence of inventor B, and an executed 37 CFR 1.63 declaration setting forth a different incorrect residence of inventor B, the Office will capture the residence of inventor B found in the
ADS
when joint inventors execute separate oaths or declarations, each oath or declaration should
make reference to the fact that the affiant is a joint inventor together with each of the other inventors indicating them by name.
If not the case, the USPTO will presume they are joint inventors but new oaths or declarations are required
If an ADS is filed before or at the same time as an oath or declaration under 37 CFR 1.63 or 1.67 and the information supplied in the two documents is inconsistent, the information provided in the XXX will always govern.
