Incorporating something into your will by mentioning it. i.e. “the list found in my desk”

It’s when you incorporate something post execution, it can only apply to tangible personal property
3 requirements for incorporating by reference
- Dated
- Signed in testator’s handwriting
- Describe the items with reasonable certainty
Exceptions to the general rule that a will isn’t a contract (3)
- Contracts to make a will
- Contracts to die intestate
- Contracts not to revoke a will

Most of these are going to be unwritten oral agreements which give the non-decedent party restitution as the only option for recovery
Contracts not to revoke a will
- Usually involves Joint wills (which are not contracts, but everyone tries to use them as such. Not common. ), and mutual wills (very common, but also not contracts).
- If no contractual language, then not binding
- If contractual language, binding.
