What are bipartite forums ?
Bipartite forums are internally setup within an in dustrial establishment for amicable relations between employer and employee.
What are the authorities that are constituted under bipartite committees?
- Works Committee
- Grievance settlement autority
What section of ID act 1947 talks about Works committee?
S. 3 of (Chapter 2) of ID act 1947
What are the requirements of constituting works committee?
- An establishment should have more than equal to 100 workers.
- there should be equal representation of employer and employee in constitution of workers committee.
What are the duties of works committee?
it is to promote amity and good relations between the employer and workmen.
it works as a safet net between employee and employer.
What are all disputes that works committee look into?
- the committee looks into the common intrest between the employer and employee by giving essential suggestions and look into dispute and giving its opinion for quick dissolution of dispute.
- the committee deals with day to day problems between employer and employee and its not for the infrequent complicated disputes or disagreements. (example: chang f condition of services)
On what principle the works committee functions on?
the works committee function on the principle of pursuasing the worker to work amicabally.
What is the nature of the decision giving by works committee?
The decision given by the worker committee is recommendatory and not binding in nature.
It is also not enforceable in court.
What are the other relevant provisions which provide for Industrial disputes act?
Rule 38 to 57 of Industrial dispute central rules 1957
how many members can constitute a works committee?
Rule 39 states that workers committee should be at max 20 members
What are the qualifications for a person to be a member of a works committe?
RUle 48 of ID central rules 1957
state that any workmen not less than 19 years of age.
he should been working in the establishment for min 1 year
What are diferent posts in the works committee and how are they selected?
- Chairman, Vice chairman, Secretary and joint secretary.
- Selection happens through election amongst themselves after becoming workers of works committee
What are the condition for dissolution of a works committee?
- proper procedure not followed in constituting the committee
- functions of works committee has been redundant
- the committee has failed to meet for 3 consecutive meetings.
Which section of ID act 1947 provide for Greivance redressal authority?
Section 9c of ID act 1947 talks about it.
it was introduced by way of amendmetn in 1982.
later it was renamed greivance redressal committee by amendment in 2010
What are the condition for constitutiong a Grievance redressal committee?
every establishment having 20 or more employess.
the committee is constituted for resolving individual disputes.
