Air commerce act of 1926
Created a new aeronautics branch soon known as a civil aeronautics administration, the precursor to the FAA
Airport and airway development act of 1970
Creates the Airport Development Aid Program and Planning Grant Program. Created federal aviation regulation part 139 certification of airports.
Airport categories
Commercial service, General aviation, cargo, military.
10,000 enplanements = primary commercial service airport
Commercial service airports
2500 enplanements.
10,000+ enplanements is a primary commercial service airport.
Hub size is determined based on what percentage of enplanements the airport receives compared to the number of total enplanements for all commercial service airports in the US.
Types of flight operations
Part 121: Scheduled air carrier certification
Part 135: Air charter or air taxi
Part 125: Corporate shuttle, Applies to aircraft with more than 20 seats or is more than 6000 pounds maximum gross takeoff weight
Part 380: Public charter’s i.e. when an airline leases a plane to a resort company
The FAA encourages airports to be
Self sustainable
The airport executive Must understand and balance to dichotomous philosophies
The airport is a public entity and must be managed as a public entity.
The airport is a business enterprise and place for commerce to take place and therefore must be managed as a business.
Legal counsel and auditor commonly reported to the board directly

FAA advisory circulars
Explain the intent of a federal regulation.
Provide guidance and information in a designated subject area.
Shown acceptable method of compliance.
May be required if “incorporated by reference” when attached to federal money.
Grant assurances
Promises the airport sponsor makes when it except airport improvement program money or land from the federal government.
Why are Grant assurances used?
Congress in the FAA have found that Grant assurances are the most effective means for extending federal government policy to local governmental units.
They allow the airport executive to better manage local affairs.
They meet FAA requirements at federal funds are use for public air transportation.
They meet the goal of federal government to promote social objectives such as disadvantaged businesses and the rights of those with disabilities
How long our grant assurance is in effect?
20 years, life if property, or life of an asset
Grant assurances require the airport operator to do what
Maintain the airport and good in good and serviceable condition. Use specific lands approved by the FAA for non-aeronautical use to generate revenue to support the Airport’s aviation needs.
Operate the airport in the public interest.
Ensure the airport operator does not grant an exclusive right to any aeronautical use tenant for any aeronautical purpose or use.
If the FAA or an aeronautical user feels that the airport is in violation of its grand assurances, it may file a complaint, with the FAA through the part 13 or part 16 process.

Part 13 investigation and enforcement. Informal complaint
Filed with the airport district office.
If the FAA believes the airport is not in compliance, the ADO will attempt to bring the airport into compliance and may issue a Notice of Apparent noncompliance.
If not corrected, the FAA or the aggrieved party may file a part 16.
