What are the goals of the Criminal Justice System?
Attempts to control crime & criminal behavior
Why was the Criminal Justice System developed?
To deal with those who go against socially & legally approved ways of acting in society
What are the 3 basic aims of the Criminal Justice System?
Control crime, prevent crime, and maintain justice
What is “Justice”?
Justice has no set definition because many people view it differently.
Even though the term “Justice” is viewed very differently by many people, why is the way we view justice important?
It has an impact on how we as a society should respond to crime & criminals, as well as satisfaction with the Criminal Justice System
How is the Criminal Justice System an “adversarial” system?
It has 2 parties competing against each other to win the case- the Crown Prosecutor, and the Defendant.
How does the Prosecution “win” a case?
By getting a guilty verdict in court
How does the Defendant “win” a case?
When the case is acquitted by a judge
What is Plea Bargaining often referred to?
Bargain Justice
What is Sentencing often referred to?
Legal Justice
What is the Due Process model?
It prioritizes the offender’s rights first to ensure no innocents people are wrongfully arrested
What is the Crime Control model?
Preventing crime at any cost
How does Crime Control ensure justice is done?
Harsher prison sentences
How does Due Process ensure justice is done?
Putting checks & balances in the system to ensure procedural justice (legal process) is followed
