Additional ways a court can modify or terminate a trust
- unanticipated circumstances threaten purpose of trust
- continuation of trust on existing terms is impracticable or wasteful
- value of the trust in insufficient to justify the cost of administration or to achieve the settlor’s tax objectives
remember: need consent of all beneficiaries if trust allocates/gives to beneficiaries that are remote or contingent (aka if A has kids)
how do we get their consent?
- a party appointed to represent their interests -or-
- representation through state law
if no “consent” then trust CANNOT be mod or term!!
how to term by operation of law
- property has been exhausted or
- legal and equitable titles have merged

- iow: trustee’s powers do not automatically terminate upon trust termination….they can stay on as trustee for a reasonable time to wind up any remaining affairs.
