Modification (Majority View)
trust can only be modified by the settlor who:
- expressly reserved the power to modify the trust; or
- has the power to revoke or amend the trust
Modification (Minority View)
settlor is free to amend or revoke a trust UNLESS the trust states otherwise
Modification (UTC)
a trust may be modified:
- by the settlor;
- if settlor and beneficiaries consent;
- the beneficiaries’ consent + modification is NOT inconsistent with trust purpose;
- it will further the trust purpose because of unanticipated circumstances;
- the cy pres doctrine applies;
- court determines the value of the trust is insufficient to justify its administration + notice to all beneficiaries; OR
- it’s necessary to conform the trust to the settlor’s intent
A court may modify the terms of a trust if:
- continuing the trust is impractical or wasteful; AND
- the modification furthers the trust purpose because of unanticipated circumstances
Common Law - ONLY administrative provisions may be modified
UTC - dispositive provisions may be modified when circumstances arise that were not anticipated by the settlor
UTC - Trust may be terminated if:
- it’s revoked or expires pursuant to its terms;
- it’s material purpose is achieved;
- it becomes unlawful, contrary to public policy, or impossible to achieve;
- the settlor + all beneficiaries consent;
- all beneficiaries consent + court decides that continuance is not necessary to achieve the trust purpose;
- termination will further the purpose of the trust because of unexpected circumstances;
- the cy pres doctrine applies; OR
- the value of the trust is insufficient to justify the cost of administration
