forming part of that witnesses evidence on oath

intended to mislead the tribunal

To be guilty of perjury a witness must maek a willfully false statement in respect of an issue that the witness believes is of material importance to the proceeding.
The intention must be to mislead the tribunal where this intention is absent no ioffence is committed.
