Cultivation of Prohibited Plants
Section 9 Misuse of Drugs Act 1975
(1) Except pursuant to a licence under this Act, or as otherwise permitted by regulations made under this Act, no persons shall cultivate any prohibited plant.
(2) Subject to subsection (4), every person who contravenes subsection (1) is liable upon conviction to imprisonment not exceeding 7 years.
(4) It shall we a defence under subsection (1) if the person proves that the prohibited plant was of species Palaver Somniferum, not intended to be source of any controlled drug or developed as a strand of controlled drug.
Allowing Premises or Vehicles to be Used
Section 12 Misuse of Drugs Act 1975
(1) Every person commits an offence against this Act who knowingly permits any premises, vessel, aircraft, vehicle to be used for the purpose of commission of an offence against this Act.
(2) Every person who commits an offence against this section is liable on conviction to imprisonment for a term not exceeding -
(a) Not exceeding 10 years where Class A Controlled Drug is the drug or offence committed
(b) Not exceeding 7 years where Class B Controlled Drug is the drug or offence committed
(c) Not exceeding 3 years in any other case.
Obstruction of Officers
Section 16 Misuse of Drugs Act 1975
Every person commits an offence against this Act who wilfully obstructs, hinders, resists, or deceives any other person in the execution of any powers conferred on that person by or pursuant to this Act.
Medicines Act 1981
Section 43 Medicines Act 1981
(1) No persons shall, without reasonable excuse, import, procure, receive, store, use or otherwise have possession any prescription medicine.
(5) Every person commits an offence against this Act who contravenes (1).
Needles and Syringes
Health (Needles and Syringes) Regulations 1998
Not an offence to possess, but will become so if syringe contains useable amount of controlled drug. An offence is committed in respect of the drug.
