How are Special Districts created and what power do they have?
Special districts (e.g. school districts or fire districts) are an independent unit of government for a specific area. Created through Referendum and have power to incur debt and levy taxes
What is the RLUIPA?
The Religious Land Use and Institutionalized Persons Act (2000).
Gives religious institutions a way to avoid ZONING law restrictions (not eminent domain). Also protects the ability if prisoners to worship as they please.
What is a “right-to-farm” law?
Denies nuisance lawsuits against farmers who use standard farming practices and have been in prior operation even if these practices harm or bother adjacent property owners or the general public
What is transferred under a TDR?
Development potential. TDR is a zoning technique that can be used to permanently protect farmland and other resources by transferring development that would otherwise occur on these resources to areas that can accommodate new development.
TDR’s avoid a taking.
What is the goal of Low Impact Development?
To preserve and recharge groundwater by using appropriate principles of site development and design
