What is S9(1) MODA 75?
Except pursuant to licence under this act, or otherwise permitted by regulations made under this act, no person shall cultivate any prohibited plant.
What is the defence to charge under S9(1) MODA 75?
It shall be a defence to charge under subsection (1) if the person charged proves that the prohibited plant to which the charge relates was a specie of Papaver somniferum and that it was not intended to be a source of any controlled drug or that it was not being developed as a strain from which a controlled drug could be produced,
What is S12(1) MODA 75?
Every person commits an offence against this act who knowingly permits any premises or vessel or aircraft hovercraft motor vehicle or other mode on conveyance to be used for the purposes of the commission of an offence against this act.
What is S16 MODA 75?
Every person commits an offence against this Act who wilfully obstructs, hinders, resists, or deceives any other person in the execution of any powers conferred on that other person by or pursuant to this act.
Note that the offence of obstruction in the MODA 75 is different to that of obstructs in Summary of offences Act 81.
