When is it an offence to damage your own property by fire?
1) To obtain a benefit or defraud a person (i.e insurance)
2) You know, or ought to know, that it is likely to endanger life
3) You know that any property mentioned in 267(1) is likely to catch fire or be damaged as a result (i.e. neighbours property)
What is the difference between arson and attempted arson?
Arson = prove that it was done intentionally or recklessly Attempted arson = must prove that there was a specific intent to commit arson
What must you prove regarding s272 for a prosecution (building an explosive)
1) Defendant either made the explosive or engine, or had them in their possession
2) Defendant intends the explosive or device to be used any another person to commit a crime
