A

A family member, caregiver, health care worker, or a peace officer will attend court if a suspected mentally ill person will NOT see a physician AND they are concerned about the person’s mental health. They must believe that the person:

1) is suffering from a mental disorder
2) likely to cause harm to that person or others OR
3) to suffer substantial mental or physical deterioration OR serious physical impairment

A

  • they then go to a reveiw panel, there are three in alberta
  • pt has right to a lawyer if they wish
  • reveiw panal reveiws if pt should be able to leave or not

A

they can do this to have the ability to treat the pt themeselves … if:

1) the pt is mentally competent but refuses to consent to treatment
2) if the pt has a decison maker who refuses tx

A

the pt can appeal to the court of queens bench (not many ppl do this
-the court decides if they will hear the appeal or not

A

issuance of community treatment order (determines if CTO is needed)

what is a form 19?

A

when two physicians (one being psychiatrist) assess the person and believe that the pt:

1) is suffering from a mental disorder
2) one or more of the following apply:
- has been a formal pt in a facility within a 3 year period, on two or more occasians, for a total of at least 30 days
- been in an approved hospital or been detained in a custodial institution, where it is evident that he/ she would have met the critera to be met as a formal pt
3) within the last preceding 3 year period, been sujbec to a CTO
4) person shows behaviours that are repeatative and indicate the pt is likely to cause harm to him/herself or others and suffer mental or physical deterioration if tehy do not recive CTO while living in community

A

they are valid for 6 month, are renewed through a form 20 before the expiration date
-no limit to the number of renewals
