What is the 2 requirement for activation of MHA
1) Abnormal state of mind / presence of mental illness
2) Person poses serious danger to themselves (including self-care) or others
What is order of sectioning under the MHA with time frame until CTO
- Application for section 8a and medical certificate 8b
- Section 9 - examination
- section 10 - certificate of preliminary assessment
- Section 11 further assessment and treatment
5 days
- Section 12 and 13 - certificate of further assessment and further assessment and treatment
14 days
- Section 14 and a - certificate for final assesmsent and application for
Compulsory Treatment Order (section 28)
What is order of sectioning under the MHA with time frame until CTO
Family COURT
- section 28 - Compulsory treatment order
-29 as an outpatient treatment
- 30 as an inpatient treatment
at 1 month - section 67: pt must have treatment explained to them and consent.
- if no consent 2nd opinion needed under section 59
At 3 months - Section 76 with clinical review for continuing the act
at 6 months further section 76
- if continuing the act need to apply for extension of CTO
- goes for another clin review at 3, 6 months
after that extra 9 months if still needing to be under the act can apply for Indefinite Compulsory Treatment Order (s34 Indefinite) Section 76
- clin review every 6 months
what are the types of treatment available under CTO , and how does pt agreement affect this
Medication, Counselling, group
therapy, education programmes, ECT (but only if you agree in
writing or if independent psychiatrist agrees)
Treatment without your agreement:
o 1st month = You can’t refuse treatment, but staff should try to get
your agreement
o After 1st month = Can refuse treatment unless independent
psychiatrist approves treatment
