what is the 5 criteria for detention under the MHA
- (likely) mental disorder
- significantly impaired decision making ability
- detemining treatment required (or giving treatment undr STD + CTO)
- significant risk - them or others
- infomral/voluntary care not appropriate
how long does an emergency detention certificate last
72hr assessment
who can authorise and emergency detention certificate
fully registered doctor = FY2 and above
(can ONLY be removed by a senior psychiatrist)
how long does a short term detention certificate last
28days
who can authorise a short term detention certificate
senior psychiatrist AND mental health officer
how long does a compulsory treatment order last
6 months initially but can be applied for a year at a time if needed longer term
who can authorise a compulsory treatment order
senior psychiatrist AND mental health officer with the approval of special tribunal hearing
(regularly checked by MHA tribunals)
