A
- Consult medical professional for info & advice on the appropriate use of S136 for an individual.
- Pan-London phone line.
- Decision lies w/ the officer.
- Consultation (or not) & advice recorded on CONNECT.
- Form 434 completion.

What are the recommended methods of transport under S136 of the MHA 1983?
A
- MH + restraint = straight to A&E.
- Ambulance to convey S136 unless violent, dangerous or extremely urgent.
- Safety & dignity.
- Ambulance is the rule, police vehicle the exception.

What are the rules around S136 of the MHA 1893 & custody & children?
A
- No children anywhere in the police station for S136.
- Child’s welfare paramount - consider PPO.
- HBPoS (Health Based Place of Safety) rule - custody exception based on risk.
- Needs inspector or above authority to use custody.
- If S136 is required & the person has committed an offence, liaise w/ a supervisor.
- As w/ physical injury, hospital may be the priority.
- You can use S136 in custody if appropriate.

What is S135 of the MHA 1983 & what powers are there to address an individual w/ MH who is AWOL?
A
- Benefits of an S135 warrant: safety / control / removal.
- MH agencies need to be clear about use of police & why.
- AWOL - police deal w/ misper.
- If location known, hospitals have powers & responsibilities to retake.
- Police: If there is a risk, accompany the MH professional.

What should you consider when using the MCA 2005?
A
- Assume individual has capacity or use ID CURE (Impairment, Disturbance, Communicate, Understand, Retain, Evaluate) to establish otherwise.
- Police involvement only in life or death situations; not to be used to detain for assessment under MHA 1983. Medical professionals & paramedics have the power too. They should not default to the police.
- Thoroughly record on form 434, because you are depriving someone of their liberty.
- A bad decision does not necessarily indicate lack of capacity.
