what is mens rea?

A

To distinguish between harmful conduct and wrongful conduct (turns something bad into something criminal)

A

A

DPP v Morgan 1976: a man only requires honest, not reasonable, belief in consent.
Sexual Offences (Amendment) Act 1976:
originally - Only counts if it is a genuine belief of consent - not an absurd one - then not guilty as no mens reas

Mens rea directed at X, actus reus takes place, but to Y.
The mens rea and actus reus must be for the same crime.
