- what was their relative business experience?
- did the challenger know that the agreement waived judicial-determined maintenance/property?
UNCONSCIONABILITY
Provision for MAINTENANCE must satisfy a 2-part test:
1- fair & reasonable at the time the agreement is made; AND
2- fair & reasonable @ time of divorce
Any other provision must just be fair & reasonable at the time the agreement was made.

1- LICENSE- only real purpose of getting a license is so that a gov’t official can make sure you have the capacity to marry
2- CEREMONY
- “a solemn declaration before an officiant and a witness”
- officiant = clergy; civil officer empowered to administer an oath; ship captain at sea
- witness = someone other than the officiant
- solemn declaration = wedding vows; no “magic words;” you just have to take the vows seriously, but that doesn’t mean you can’t have a wacky/weird wedding
Common Law Marriage in NY
