- Lottery
and pharmaceuticals where you are:
• Not allowed to market prescription drugs
• Not allowed to market drugs that are not yet approved for sale
• Cannot mislead the consumer to think it has other effects than it is tested and approved for
• Must provide information on the correct usage of the drug
What is the rule of thumb for what is defined as marketing law?
All market communication that a company pays for is marketing
When is something deemed not according to marketing practices?
Marketing not in line with good marketing practices is deemed improper if it noticeably or likely affects the recipients ability to make a well- informed business or consumption decisions,
Define misleading marketing
- Prohibited to use wrongful statements or phrasing that is misleading of your own or someone else’s business,10 MPA. All statements must be true and correct.
Especially about
• Quality, quantity and other characteristics
• Origin, usage, affects on health and environment, etc.
• Price, payment plans, discounts, etc.
• Customer service, delivery, complaints, returns, etc.
- Cannot leave out essential information that makes the communication misleading (also includes cases where information is unclear, incomprehensible or in other ways inappropriate), 10 p.3
What are some examples of misleading marketing?
- Wrongful statements
- Leaving out essential information to make it misleading
- Creating an illusion of connection to another brand
- imitations of a distinctive products
- Deceptive comparison to competitors ( has to be true and correct view, focuses on measurable characteristics, does not discredit or take unfair advantage of that companys goodwill)
EXTRA BAD:
- Deceptive marketing - if it affects the consumers ability to make a well informed (business) decision,
- Aggressive - if it contains harassment, force, threat or physical violence, 8 MPA
