Appearance Notice
A legal document sent out to the accused to appear in court. But it is used for less serious offences.
Arrest
A police officer places the person under arrest, which means that the person has had their rights taken away legally and must stay in custody of the police officer. To make the arrest legal the police officer must identify himself/herself, tell the accused that they are under arrest, tell them what the charge is and show them the arrest warrant, touch the person to say that he or she is in legal custody.
Arrest Warrant
a written court order stating that the police must arrest the person that may have committed the crime
Bail
when the person posts a some of money or other security to guarantee their appearance at court
Bench Warrant
an arrest warrant given by the judge, when the accused does not show up to court
Detention
Detention means you are being detained and you are allowed to call a lawyer for legal advice since you now know what you are being charged with.
Information
the report given under oath, telling the court the specifics of what happened when the offence was made.
Line-up
A group of people that are shown to the victim or the witnesses to say who the accused is.
Peace Officer
someone who is responsible for keeping the public peace-mayor, police officer, customs officer etc.
Promise to Appear
when the accused signs an agreement that says the time of the trial and when they will appear in court.
Reasonable Grounds
information that would tell a sensible person to say that the accused/suspect has committed the criminal offence.
Recognizance
Means that the accused must come to court, and if the accused does not appear in court when they need to they will receive a fine up until $500.
Reverse Onus
Up to the defence to show why bail should happen
Search Warrant
a legal document that police officers receive from court that gives them the right to search a certain place.
Show Case Hearing
If bail doesn’t happen the crown needs to show case why the person needs to continue to stay in jail
