What’s is s.23 LTA 1954?

A

To obtain protection under the act there must be a business tenancy (6 elements) :

  1. It is a tenancy
  2. Premises used for business
  3. Occupation of at least part
  4. Occupation for more than 6 months
  5. Not a TAW or service tenancy
  6. Must be a competent LL (landlord with more than 14 months to run)

A

Must be served on the competent landlord and in writing.

S.27(1) the tenant must serve no less than 3 months notice

S.27(1a) is when the tenant wishes to vacate on the expiry date or before, however, the lease will end on the expiry.

S.27(2) is when the tenant wishes to vacate after the expiry (no less than 3 months notice)
