3.210 Vehicle Pursuit
Area lieutenant (watch commander in area lieutenant’s absence) will:
- Monitor the pursuit and ensure it is conducted per department policy, procedures, and training.
- Allow the monitoring supervisor to remain in control of the pursuit.
- Continuously evaluate the need to authorize additional units to the pursuit.
- During the pursuit, consider use of PIT and/or stop sticks.
- Refrain from radio communication that may cause confusion regarding supervision of the vehicle pursuit unless to countermand the monitoring supervisor in charge of the pursuit.
- Discontinue the pursuit over the radio when apprehension of the fleeing suspect(s) is outweighed by the danger caused by the pursuit.
A. Confirm that speeds of pursuing units and fleeing vehicle are reasonably being broadcast over the radio throughout the duration of the pursuit. - Respond to the termination point of the pursuit.
- Ensure all required post-pursuit procedures are completed.

Precision Intervention Technique (PIT)
PIT as deadly force
a. At speeds of over 40 mph.
b. Used on motorcycles.
c. Used on high center-of-gravity vehicles likely to roll over.
d. Used on vehicles that are significantly heavier/larger than the primary unit (e.g., buses, motorhomes, semitrailers).
e. Circumstances that create a substantial risk of death or serious bodily injury.
f. Circumstances warranting the use of the PIT as deadly force include:
1) Continued movement of the pursued vehicle would place others in danger of bodily harm or death other than the occupants of the vehicle; and/or
2) Apparent risk of harm – to those other than the occupants of the pursued vehicle – is so great as to outweigh the risk of harm in making the forcible stop; and
3) Other means of apprehension during the pursuit have been considered and rejected as impractical (e.g., continue to follow, bubble tactic, stop sticks, call for the Air Unit, and/or discontinuance).
g. (CIRT) will complete the appropriate reports for incidents where deadly force is used (PIT or ramming).
1) In incidents where PIT (deadly) or ramming is used, the use of force will be handled by CIRT at the discretion of the CIRT lieutenant, based on the totality of the circumstances.
3.220 Foot Pursuit
A supervisor will respond to a foot pursuit when the following occur:
- Injury to an officer, citizen, or suspect;
- Any entry into a residence or similar structure, regardless if it is occupied or not;
- Any reportable force; or
- Any other unusual occurrence that warrants supervisory oversight.
Upon apprehension of the suspect, the supervisor should promptly respond to the termination point and direct post-pursuit activity. Supervisors should conduct an after-action review with the officer(s) involved

Dispatch a minimum of three officers to the call.
3.400 Responding to persons in Behavioral emergency
The responding patrol officer will:
- Assess situation and confer with on-site first responders to determine if the person is suffering from a behavioral emergency.
- If a behavioral emergency is suspected, request medical personnel, supervisor, and CIT officer to respond immediately if they have not already been dispatched.
- Establish containment of the area.
- Formulate a custody plan with other officers. The object of the plan is to de-escalate the situation, calm the individual, and gain control of the person
a. The custody plan will include a designated officer to monitor the subject’s breathing. - Observe the subject and communicate observations to medical personnel.
- Execute the custody plan quickly once sufficient officers are present to prevent the escalation of the behavioral emergency. If possible, the plan should be executed after medical personnel have arrived.
- Take appropriate steps for care of the individual:
a. Place the subject in the recovery position (i.e., the placement of a subject’s body in a manner that does not restrict breathing or obstruct the airway such as on their side or upright). While handcuffed subjects are seated, they will not be forcefully bent forward at the waist, and pressure will not be applied to their back, neck, or head.
b. Consider the use of two sets of handcuffs to avoid escalating a potential medical emergency.
c. Monitor the subject’s breathing. A subject who becomes quiet or who no longer offers resistance should be immediately assessed to ensure the subject is breathing and has a pulse.
d. Coordinate with medical personnel to transfer custody of the subject to them, assisting to avoid delay in transportation. - Prior to transport, if a subject is combative and removing the handcuffs has the potential to place those present in danger, the handcuffs will remain on the subject. In this circumstance, the officer will escort the subject in the ambulance to assist in the removal of the handcuffs.
- Respond to the medical facility to complete paperwork, which may include a Legal 2000, DOAR, and/or CIT After Action Report.
3.500 Major Incident

- Verify command has been established.
a. If command has already been established, the lieutenant will determine if command needs to be transferred to the lieutenant position. This will be based on the size, type, and complexity of the incident. On less complex incidents, the lieutenant may choose to leave the sergeant or officer in command and mentor the sergeant or officer. The lieutenant will ensure that the decisions made by the sergeant or officer in the position of IC are sound and within the guidelines of department policy.
b. Determine the need for additional ICS command and general staff positions. - Ensure the watch commander has been notified.
- Ensure that all requests for regional, state, or federal resources are made through the Department Operations Center (DOC), thereby permitting the Emergency Management Section oversight of these requests

- Ensure officers and patrol supervisor are addressing the situation to a standard and make adjustments as needed.
- Discuss the incident with the SWAT or tactical commander.
a. The available intelligence on the subject’s background and motivation.
b. The nature and severity of the crime (determine the threat to the public).
c. The necessity for a large-scale tactical response and neighborhood evacuations versus surveillance and other means to de-escalate the situation and prevent a use of deadly force. - Designate a location for evacuated citizens to gather that is safe and has facilities (e.g., schools or shopping centers).
- Establish an ICP that:
a. Is secured and is in close proximity to the scene, but is not in the line of sight of the suspect;
b. Has an area for responding units to stage; and
c. Has unobstructed radio and telephonic communications. - Establish ingress/egress routes.
- Request fire and medical support to the command post.
- Assign an officer to function as recorder to maintain a chronological log of events.
- Advise Communications of the command post phone number.
- Assign a patrol supervisor or designee to the TOC, if necessary.
- Request the Traffic Section supervisor to take control of the outer perimeter and any travel routes, thereby relieving patrol personnel.
- Maintain control over the relief and deployment of patrol officers.
- Function as or designate a media liaison, unless the Public Information Office (PIO) is present.
- Notify Emergency Management coordinator when appropriate.

In the event a bomb threat is called in against LVMPD headquarters (HQ), radio silence will be maintained. HQ operations will not be disrupted, and personnel will not be evacuated without justification as determined by officers on scene.
HQ Security Detail/BAC units will: Begin a search of the HQ parking lot, grounds, and public access areas. Officers on scene may request K9 units for an area sweep.
3.520 Bomb threat
Watch commander will:
- Ensure that the threat is handled in accordance with policy.
- Send an email detailing the incident to the Community Policing Division deputy chiefs, the Homeland Security and Special Operations Division Deputy Chief, the Division Director of the Business, Technology and Support Division, the ARMOR supervisor, the SNCTC commander, the Communications Bureau commander, and the Office of the Sheriff executive captain/lieutenant.
- Ensure an entry is not made in the Watch Commander Log.
Command and Control
Two command and control locations will be established when a device or suspected device is located.
- The Tactical Operations Center will be in the vicinity of the device determined suitable by ARMOR supervisor. Command of the primary location and all personnel assigned to it will rest solely with the ranking ARMOR member. The overall incident command will remain with the patrol IC.
- The field command post (CP) will be operated and staffed, and a staging area established as for any unusual occurrence, by LVMPD personnel, who will oversee all field operations in connection with the explosive. Investigative personnel will report to the field CP or staging area as directed, when arriving at the scene

b. If protesters still refuse to release and disperse, request the HSST through Dispatch. - Direct officers to create and maintain a buffer zone, ensuring inbound foot and vehicle traffic is diverted.
- Designate an arrest team to take custodial arrest and complete booking of protesters once released from their devices by HSST (consider notification to DSD if multiple arrests).

MACTAC Response Procedure
Area lieutenant will:
- Upon arrival, confirm the incident meets MACTAC incident parameters.
- Determine need for additional patrol resources. Resources should be requested through utilization of MACTAC alerts and/or MACTAC activations.
- Ensure unified command has been established per NIMS.
- If one of the first arriving officers or sergeants has taken IC, determine if a transfer of command needs to occur from the current IC to the lieutenant. This will be based on the size, type, and complexity of the incident.
- Determine the need for additional ICS command and general staff positions based on the size, type, and complexity of the incident.
- Ensure the watch commander has been notified.
- Ensure that all requests for regional, state, or federal resources are made through the Emergency Management Section.
- Complete the ICS After Action Report (LVMPD 422) for ICs within 10 calendar days of the conclusion of the event if the lieutenant held the position of incident commander.
- Forward the LVMPD 422 electronically to the Emergency Management Section. The IC is responsible for the completion of the LVMPD 422.
- Only one LVMPD 422 is necessary for an incident/event
4.100 Arrest procedures
- NCF (No Charges Filed) Procedures
If the arrest does not meet all the necessary requirements, the charge(s) can be released by filing for NCF. Arrests will not be routinely NCF’d from the Las Vegas City Detention Center. NCF must be done within 48 hours of the time of arrest in the field otherwise the release must be coordinated directly with the DA, as the authority to release is out of the control of LVMPD

4.106 Orders of protection
It is the policy of this department that when notification is returned NCIC, NCJIS, or other source, that a person is the subject of a temporary or extended order for protection, notice and/or service will be made of that order.
In addition, an arrest will be made when there is a violation of a temporary or extended order for protection reference domestic violence, restraining order or stalking/harassment order when determined that the adverse party has been notified/served.
- Notification- This is the process of notifying an adverse party that a court order has been issued against them and requiring them to obtain a copy of the court order.
- Extended protective order (EPO) - An extended order for protection against domestic violence may only be granted after notice to the adverse party. It can be extended for up to two years or as indicated on the order itself. Extended orders are issued at the court hearing prior to the expiration of the temporary order.
- Temporary protective order (TPO) - A temporary order for protection against domestic violence may be granted without notice to the adverse party. It is generally valid for 30 days or until the scheduled court appearance indicated on the back side of the order.

ICE
It is the policy of this department to recognize the dignity of all persons, regardless of their national origin or immigration status.
When a foreign-born individual is arrested and charged with a violent felony, DV, DUI, burglary, theft, larceny, petit larceny, and/or assault of a law enforcement officer, the Detention Services Division (DSD) will notify ICE at the time of both booking and release. These charges have the highest impact on public safety.
4.196 Community Responder Outreach
Rebuilding Every City Around Peace (RECAP)
The RECAP board consists of the Assistant Sheriff of the Law Enforcement Operations Group, a Deputy Chief of the Patrol Division, the OCE commander, and three active RECAP leaders. The OCE commander or designee will set meeting agendas and facilitate the meetings.
The board will meet semiannually (at a minimum) to set goals, foster open dialogue, ensure collaboration on relevant community policing initiatives, and review and monitor activation activity.
4.196 Community Responder Outreach

Proactive Activation: Community Event in Partnership with RECAP
Bureau commander or designee will:
- Determine if a proactive activation is needed to build rapport and trust among areas of the community with potential for violent criminal activity, distrust of law enforcement or other community needs that can be addressed.

The exact type and coordination of the event will be at the discretion of area command Community Oriented Policing (COP) units and with the technical assistance, if needed, of OCE staff in collaboration with activation responders. - The event can take the form of a peace rally, neighborhood march, walk, barbecue, resource fair, carnival, etc.
- The event will be conducted in conjunction with community and faith-based volunteers, organizations, and agencies.

CCRO is a collaborative partnership between the Traffic Bureau and faith-based community leaders, community partners, and certified volunteers. CCRO activations are initiated on a case-by-case basis when a crash results in critical bodily harm or fatality.

Probable cause vehicle search:
If a vehicle is readily mobile and probable cause exists to believe it contains contraband or evidence, the Fourth Amendment permits officers to search the vehicle. The search may include all locked or unlocked containers located inside the vehicle where the item may be found.
* Fresh pursuit- Occurs when there is probable cause that a person, who is wanted for a serious felony, is inside a home or other private place and is about to flee. (Not to be confused with hot pursuit.)
* Hot Pursuit: A sub-category of “exigent circumstances” allowing entry into a structure when there is probable cause to believe a dangerous person has committed a serious felony. The suspect is fleeing from law enforcement and the officer has direct knowledge of the suspect’s location. (Not to be confused with fresh pursuit.)
* Curtilage : Area(s) near a residence where the residents have a reasonable expectation of privacy. Considerations in determining whether an area is curtilage and subject to the protections of the Fourth Amendment are: (1) proximity of the area to the home; (2) whether the area is included in an enclosure which surrounds a home; (3) nature of uses to which an area is put; (4) steps taken to protect the area from observation from passers-by. The legal protection associated with curtilage is always determined in favor of the property owner, not law enforcement.
Open view : What a person knowingly exposes to the public is not protected by the Fourth Amendment no matter where the exposure takes place. It does not justify a warrantless seizure. (Not to be confused with plain view.)

- The area sergeant or lieutenant will respond to all major incidents/scenes and assume command from the patrol officer at the scene. It will be the responsibility of the area sergeant, lieutenant, or incident commander to evaluate the circumstances and determine the need for CSI. The area sergeant will provide the details of all major incidents/scenes to the watch commander
6.360 Crime Scene

- When a patrol officer arrives on the scene in a supervisory capacity, they will assume the responsibility of evaluating circumstances and directing and coordinating the efforts of those officers assigned.
- Crime Scene Photographs on Dynamic/Rapidly Evolving Incidents and Crime Scenes
Photographs of crime scenes will be taken, handled, and disseminated in the following manner:
1. Typically limited to terrorist attacks or mass casualty incidents with a reasonable belief that there are additional suspects or accomplices who must be identified rapidly and that a delayed response may result in additional loss of life or suspects’ escape from the city, state, or country.
2. Sergeant or higher will take the photographs, authorized by a lieutenant or above, utilizing only a department-issued device; no personal devices may be utilized
3. Photographs may be disseminated to the Special Operations Bureau (SOB) commander, SNCTC commander, or a Deputy Chief or above.
4. Photographs will be uploaded to OnBase and Evidence.com for potential discovery later and maintained in the case file of the originating investigative unit along with a copy of the log, memo, or email supporting the exception.
5. Document the exchange/change of custody via a log, memo, or email, and the necessity for rapid movement of information and exception to the crime scene preservation within 24 hours. The log, memo, or email are to be kept at the division commander level and archived on the H: drive and OnBase.
6. The bureau commander will verify the photograph deletion (and their upload to OnBase and Evidence.com) from the department device to limit further distribution by the end of shift (or 24 hours) once initial distribution is made to authorized personnel.
7.136 BWC
**Supervisor Access **
Supervisors will only access BWC footage for investigative purposes (e.g., complaints, uses of force, vehicle pursuits, allegations of misconduct, etc.) or as otherwise outlined in department policy. In each case, the individual accessing the footage will note the specific video reviewed and the reason for the review in Evidence.com. However, when a supervisor opens an SOC due to conduct observed during BWC footage review, documentation will be within the SOC itself rather than in Evidence.com, particularly if the SOC must be kept confidential. If a supervisor is documenting a BWC review in an SOC, it is not necessary to also document the review in Evidence.com.
7.136 BWC
Upon receiving a complaint and the incident may have been captured on BWC, supervisors will: except
- Handle complaints in accordance with LVMPD 8.330, Maintenance of Values and Ethics.
- Interview the complainant before reviewing any available BWC footage when possible.
a. Record the interview utilizing the BWC. Supervisors not wearing a BWC should consider having another field supervisor record. - Access the footage regarding the complaint on scene through a mobile device or any MDT.
a. Supervisors will not review footage in the presence of the complainant. - Not record the subject or witness officer during the investigation.
- If the allegation appears to be valid, document in the narrative of the SOC that BWC footage is available, has been reviewed, and serves as a basis for the SOC.
- If the allegation is not a violation of policy or law, document this in Blue Team through a Citizen Contact Report that BWC footage is available and has been reviewed.
- When BWC footage establishes probable cause (PC) that a citizen is falsely reporting a crime notify the Internal Affairs Bureau (IAB) Criminal Investigations Section on-call supervisor for further direction.
7.260 WATCH COMMANDER/AREA LIEUTENANT INCIDENT NOTIFICATION

the flow of information is managed and that guidelines and procedures are established to control information regarding certain incidents. The watch commander and the on-duty area lieutenant will be notified of any critical incidents that may require command-level review.
The WC will notify or ensure the area command sergeant and/or lieutenant notify the appropriate Area Captain, Tourist Safety Division Deputy Chief, or Community Policing Division Deputy Chief by phone on all Homicides, Barricades, Employee Involved Shootings/Use of Deadly Force, Employee Deaths/Serious Injuries, Employee Arrests, Prisoner Escapes, and other Significant Events.

a. Spark Display – a non-contact demonstration of the ECD’s ability to discharge electricity.
b. Touch Stun – a pain-compliance application of the ECD, with or without the use of a cartridge, by making direct contact against the subject’s body. The use of a Touch Stun application is discouraged unless used to complete neuro-muscular incapacitation by closing a circuit when probes have already been deployed.
