Dishonestly taking OR using a document
s228(1) (a) or (b) CA 61 - 7 years imprisonment
With intent to obtain any property, service, pecuniary advantage, or valuable consideration - dishonestly - and without claim of right -
(1) (a) - takes or obtains - any document
(1) (b) - uses or attempts to use - any document
Obtaining OR Causing loss by deception
s240(1) (a) or (b) or (c) or (d) CA 61
By any deception - and without claim of right -
(a) - obtains ownership or possession of, or control over, any property, privilege, service, pecuniary advantage, benefit, or valuable consideration - directly or indirectly;
(b) - in incurring any debt or liability, obtains credit;
(c) - induces or causes any other person to deliver over, make, accept, endorse, destroy, or alter any document or thing capable of being used to derive a pecuniary advantage;
(d) - causes loss to any other person
Penalty for obtaining or causing loss by deception
s241 CA 61
(a) - exceeds $1000, 7 years imprisonment
(b) - between $501 and $1000, 1 year imprisonment
(c) - $500 or under, 3 months imprisonment
Forgery - Makes a false document
s256 CA 61
(1) 10 years imprisonment, makes a false document - with the intention of using it - to obatin any property, privilege, service, pecuniary advantage, beneift, or valuable consideration.
(2) 3 years imprisonment, makes a false document - knowing it to be false - with the intent that it in any way be used or acted upon - whether in NZ or elsewhere - as genuine.
Using forged documents
s257(1) (a), (b) or (c) CA 61 - 10 years imprisonment
Knowing a document to be forged -
(a) - uses the document to obtain any property, privilege, service, pecuniary advantage, benefit, or valuable consideration;
(b) - uses, deals with, or acts upon the documents as if it were genuine;
(c) - causes any other person to use, deal with, or acts upon it as if it were genuine.
Altering, concealing, destroying, or reproducing documents with intent to deceive
s258(1) (a) or (b) CA 61 - 10 years imprisonment
With intent to obtain - by deception - any property, privilege, service, pecuniary advantage, benefit, or valuable consideration - OR to cause loss to any other person -
(a) - alters, conceals, or destroys any document, or causes any document to be altered, concealed, or destroyed;
(b) - makes a document or causes a document to be made that is, in whole or part, a reproduction of any other document.
Using, altered or reproduced document with intent to deceive
s259(1) (a) or (b) CA 61 - 10 years imprisonment
Knowing any document to have been made or altered in any manner and with the intent referred to in s258, with intent to obtain by deception - any property, privilege, service, pecuniary advantage, benefit, or valuable consideration = Or to cause loss to any other person -
(a) - uses, or deals with, or acts upon, the document;
(b) - causes any person to use or deal with, or act upon, the document.
Accessing computer system for dishonest purpose, and thereby
s 249(1) (a) or (b) CA 61 - 7 years imprisonment
Directly or indirectly - access any computer system - and thereby - dishonestly or by deception - and without claim of right -
(a) - obtains any property, privilege, service, pecuniary advantage, benefit, or valuable consideration;
(b) - causes loss to any other person
Accessing computer system for dishonest purpose, with intent
s 249(2) (a) or (b) CA 61 - 5 years imprisonment
Directly or indirectly - access any computer system - with intent - dishonestly or by deception - and without claim of right -
(a) - obtains any property, privilege, service, pecuniary advantage, benefit, or valuable consideration;
(b) - causes loss to any other person
Damaging or interfering with a computer system, danger to life
s 250(1) CA 61 - 10 years imprisonment
Intentionally or recklessly - destroys, damages, or alters - any computer system - if he or she knows or ought to know - that danger to life is likely to result
Damaging or interfering with a computer system, no authority
s 250(2) (a), (b) or (c) CA 61 - 7 years imprisonment
Intentionally or recklessly - and without authorisation - knowing that he or she is not authorised, OR being reckless as to whether or not he or she is authorised -
(a) - damages, deleted, modifies, or otherwise interferes with or impairs any data or software in any computer system;
(b) - causes any data or software in any computer system to be damaged, deleted, modified, or otherwise interfered with or impaired;
(c) - causes any computer system to
(i) - fail or;
(ii) - deny service to any authorised users
Accessing computer system without authorisation
s 252(1) CA 61 - 2 years imprisonment
Intentionally accesses - directly or indirectly - any computer system - without authorisation - knowing that he or she is not authorised to access that computer system - OR being reckless as to whether or not he or she is authorised to access that computer system
