What do you include in a valuation for Canford School? / how do you undertake it.
I would take the contractors application and review against the completed works on site. This includes measurement, reviewing works against drawings and specifications and assessing variation costs. I prepare an issuing letter, interim certificate and statement retention.
What is a statement of retention under standard building contract?
Details the individual breakdown of retention on the project.
What was included in the CDP items for St Annes Catholic School Roof replacement?
M&E removal and installation.
What was the relevant event at which DSU was placed under?
Deferment of possession.
How are liquidated damages calculated for DSU extension of time?
Genuine pre-estimate of the loss to the client. Per bed, additional fees to administer the contract from the clients side.
What would you see on an extension of time issue letter?
Date, delay period from the contract completion date, causes of the delay, programme appended, link to the relevant event in the contract. when the delay arose. formal letter head.
How would you assess an extension of time notice?
Contractor provide formal written notice of delay by the terms of the contract.
Measurement of the delay is the difference between the completion date and the current contract completion date.
A contractor will only be entitled to an extension of time for the period of delay for which the employer is responsible under the contract.
Therefore once the delay period has been established it is necessary to work out whether the contract is entitles to all, some of none of the additional time taken to complete the works.
The actual period of delay will not be known when an extension of time claim is being made and assessed. EOT are often dealt with prospectively (before completion date is known).
How to measure a delay? Methods?
Simple and complex ways.
Overview of the facts. Compare actual progress of works with planned progress.
Adopting critical path analysis.
Review of the facts, emails, letters, meetings, photographs, records pf progress. isntructiond drawings and other documents.
Eg delay from instruction, deferment of possession, stopping on site halting works. Dates, events and consequences.
The comparing actual progress against planned includes comparing planned timings of the programme activities with the as built timings. Why was the actual progress not as planned?
