What would you do if there are some mirrors to be installed, would you still issue practical completion?
I would liaise with the Client to see whether the mirrors are detrimental to the possession of the area. If they are then I would not grant practical completion. If not I would include them on the defects list, noting on the practical completion certificate that they were required to be installed. I would advise the client that the Contractor is responsible for the supply, safe delivery and installation of the mirrors. I would check the area is fit for use. I would assess the scope of disruption if remedial works are required if the area is taken possession before the defects is rectified.
What do you need in order to grant practical completion as a CA?
Building control certificate
O&M manual
Testing certificates
Demonstrations and training
Defects schedule which has been rectified.
Collateral warranties
What happens if building control do not provide their certificate? Example of why they aren’t linked to PC
Unless the contract provides otherwise there is no link between the two, although refusal by the building control officer is a good indicator to the CA. EG, refusal may be linked to a client design issue and actually the contractor have done everything they could do and are entitled to completion. Building control officer not interested in external works, decorations, aesthetic defects which may be a legitimate cause for the CA to not issue PC.
What happens to bonds and guarantees at PC? What do they do?
Guarantee the performance of the contractors obligations. Expire at PC.
Explain the payment provisions of JCT Contracts?
JCT Intermediate Contract with Contractors Design:
Application date is the same date on each month or nearest business day as the date of posession.
Due date is 7 days from the due date
Final date for payment is 14 days from the due date.
Pay less notice is 5 days from the final date for payment.
