Landlord’s Duty to Provide Habitable Premises (Modern Law)
Although under common law the landlord had duty to deliver the premises in habitable condition, modern law imposes an implied covenant of habitability on the landlord usually applicable only to residential leases, requiring that the premises be in a habitable condition.
Landlord’s Duty to Repair (Modern Law)
Modernly, the landlord’s duty to provide habitable premises has been expanded to an ongoing duty to keep the premises in a habitable condition by making reasonable and necessary repairs.
Assignment
An assignment is the transfer by the lessee of his entire interest in the leased premises.
Sublease
A sublease is transfer by the lessee of something less than his entire interest in the leased premises.
