What is procedural law?
Rules that govern the mechanics of resolving a dispute in court or administrative agency.
What are the characteristics of a paralegal?
- Acquired legal skills through education, training, or on-the-job experience
- Works under attorney supervision
- Performs substantive legal work that an attorney would have to do if they didn’t have a paralegal.
Why do attorneys choose to work with paralegals?
- Help keep costs down
- Enables attorneys to do more work.
What is AAfPE?
American Association for Paralegal Education, founded in 1981, serves paralegal education and institutions that offer paralegal education programs.

What is a paralegal?
A person who is qualified through education, training, or work experience and is employed by a lawyer, law office, government agency, or other entity to work under the discretion of an attorney in a capacity that involves the performance of substantive legal work.
What is a pleading?
Complaint of plaintiff’s first court filing.
What is fee shifting?
A rule that allows a plaintiff to recover costs from the defendant if the plaintiff wins.
In what situations does fee shifting occur?
- Prior agreement
- Bad faith
- Special statute.
What was the ruling in Missouri v. Jenkins?
The District Court correctly compensated the work of paralegals, law clerks, and recent law graduates at the market rates for their services.
What is an amicus curiae brief?
A ‘friend of the court’ brief, filed by an individual or organization to present arguments in addition to those presented by the immediate parties to a case.
What is the realization rate?
The percentage of the total amount billed by a timekeeper that is received by the law firm as income.
What is the Rule of 3?
A general guideline used by firms to identify budget expectations from hiring paralegals; gross revenue generated through paralegal billing should equal three times the paralegal salary.
What does a paralegal do?
They do the work that only an attorney would otherwise be qualified to do, including legal research, case development, planning, clerical work, filing, and keeping track of communications.
Is a paralegal an attorney?
