What’s the DIFFERENCE between 267(1) and 267(2)
THE MAIN DIFFERENCE IS IN THE PROPERTY
267(1) is Immovable property and vehicles, ships and aircraft. (High value property)
267(2) is property not included above (Less value property)
267(1)(c) omits Recklessness where as 267(2)(b) includes Recklessness.

What is the purpose of 267 sections (2) and (3)
Lower-value property is dealt with in subsections (2) In subsection (3) it’s the burning of property when there is risk to other property.
Is Recklessness an element of Attempted Arson

Section 268 Crimes Act 1961
Attempted arson
Every one is liable to imprisonment for a term not exceeding 10 years who attempts to
commit arson in respect of any immovable property or any vehicle, ship, or aircraft.
What are the two ingredients the crown must prove regarding the offence of Attempting to commit Arson?
The crown must prove:
(1) INTENT to commit the offence, and
(2) ACTED FOR THE PURPOSE OF ACHIEVING THAT AIM. I.e. take a real and substantial step leading up towards achieving that aim. It must go beyond mere preparation.
An offence may constitute an attempt if it
is immediately or proximately connected with the intended offence.

Providing explosives to commit an offence
Every one is liable to imprisonment for a term not exceeding 2 years who
knowingly has in his or her possession or
makes any explosive substance, or any dangerous engine, instrument, or thing,
with intent to use or enable another person to use
the substance, dangerous engine, instrument, or thing,
to commit an offence.
