What is a statute?
an act of legalisation- e.g a law
What is the European Convention of human rights?
The convention guarantees a number of rights, including respect for privacy and freedom of expression
what article is the European of human rights?
Article 10
what does the criminal law deal with?
deals with offences which harm the community e.g rape, murder and burglary
who goes to a youth court?
children go to a youth court, under 18s, extreme cases still go to crown or if there an adult co-involved
what does magistrates court deal with?
magistrates court deals with 90% of criminal cases and sends the rest to crown
who does crown court deal with?
Crown court deals with the most serious cases including murder. A defendant who wants to appeal against a Crown court conviction or sentence can seek permission to appeal to the Court of Appeal crim. division.
how many judges normally hear an appeal?
3 judges will hear am appeal and make a decision
what does the civil law deal with?
civil law deals with disputes between individuals & organisations and the redress of “torts” - civil wrongs (for which a court may award damages) – such as negligence, defamation and personal injury.
which court would someone go to in terms of a tort-civil wrongs?
civil tourts are dealt with at a county court.magistrates would deal with family law. high court deals with most serious cases such as defamation and privacy
a claimant and defendant may reach a what before a trial?
a settlement, this means there will be no court judgment
