Q

what are search reports ?

A

A search report in the context of patents is a document that provides the results of a search for prior art conducted by a patent office examiner. The goal of the search is to identify any earlier publications, patents, or other publicly available documents that might affect the patentability

Documents (3-5) closest to the invention are listed in search report and sent to applicant for response

Q

and if so what part can not be amended ?

A

Patent claims can be amended even after grant is given but Cannot add examples or extend subject
matter of claims
No amendment can add technical subject matter

17
Q

What does an applicant have to do after a patent application is published ?

A

After this, the applicant has a 6-month window to request examination.
whether the invention meets the legal requirements for patentability, including:
-Novelty: Is the invention new compared to the prior art?
-Inventive Step (Non-Obviousness)
-Industrial Applicability
-Sufficiency of Disclosure

18
Q

When does publication of an patent application occur

A

18 months after priority date

19
Q

Which is more of an aggressive examination a search report or Substantive Examination?

A

The substantive examination process is more rigorous than the earlier search report stage, as it involves a legal assessment of whether the claims of the application deserve patent protection.

20
Q

Patent application timeline?

A

application —– search report———aplication publication )-18months
—–publication of grant)-3/4 years —-Opposition period expires)-9 months

21
Q

When do renewal fees start?

A

after second anniversary of filing patent
Cost increases each year
EP costs about 3-4 national patents
(fees, patent agent)

22
Q

when can opposition file against a patent ?

A

Within 9 months of patent grant any third
party may file an opposition against the
patent (and pay fee)
– Outcome decided by independent Board of Appeal of EPO

23
Q

What grounds would a company oppose a patent ?

A

Grounds for opposition based on EPO article 100
-Grounds that patent does meet requirement of patentability e.g new, innovative, morality, not apart of prior art, has to have industrial application.

-Under ground patent is not clearly/ completely explained
-If, during the prosecution of the patent, the applicant amends the claims or the description in a way that introduces new subject matter that wasn’t disclosed in the original application, the patent can be opposed on this ground.

24
Q

What are the possible outcomes of opposing a patent?

A

-Opposition is rejected and the patent is
maintained as granted
– The patent is maintained in an amended
form, in which case a new patent
specification is published
– The patent is revoked

  • Can be appealed within 2 months of
    decision date of notification
25
Q

What is a PCT?

A

It is patent co-operation treaty, basically a international patent, Its a single method of application for 152 countries

26
Q

What are the steps before an international patents is applied ?

A

File national application to cheaply establish priority
* Pay fee for worldwide
professional patent search
* Examine search report

27
Q

International patent application timeline ?

A

File PCT (international)—-international search report and opinion given—international publication—-demand international preliminary examination——international preliminary report on patentability

28
Q

Why is speculation section of patent potentially harmful?

A

Speculation where future technology is going may lead to patents denied in future
