- Law- Employment (Termination and Redundancy) Payments Act 1974- covers separation payment whenever an employee is being made redundant/terminated
Britain’s law involves protection rights against discrimination, unfair dismissal etc.
Industrial relations law is characterised by the principle of:
Voluntarism
- Trade union Act 1919(amended 1938), Labour Relarions & Industrial Disputes Act 1975
gives framework for labour union recognition and industrial dispute resolution and other activities
Industrial safety Law
- Factories ACT 1943- for workers in manufacturing
- No comprehensive lae in Jamaica
-Britain has the Safety at work Act- 1974
-OSHA in place
Three purposes of labour laws
Protective Legislations
Auxiliary Legislations and
Restrictive Legislations.
Protective Legislations Primary purpose to protect the workers against
unfair treatment, examples;
Minimum Wage Act
Factory Act (Occupational Safety and Health Act)
Equal Pay (for Men and Women) Act
Maternity Leave Act
Employment (Termination and Redundancy)
Payments Act
Auxiliary Legislations
-Auxiliary legislation is intended to support the
establishment of collective bargaining.
Trade Union Act 1919-
LRIDA- registration in 30 days of formation, perosns over 16 (though 16-18 cannot hold positoin)
Filing of statememnts- By treasurer before or on Aug 1 of each year
Peaceful picketing
Prohibition of certain practices- intimidation, hiding tools, lock outs
Restrictive Legislation
- imit the
scope of their activity, particularly as it
relates to the disruptive impact of industrial
action, example LRIDA
