What is the difference between a Lease & a Licence
A lease grants exclusive possession whereas a Licence is used for a specific purpose and generally for a shorter period of time
When does a lease need to be drafted by a solicitor?
Anything over 3 years must be executed as a deed and drafted by a solicitor. Any lease over 7 years must be registered at the Land Registry.
What is a Herbage agreement?
Where a Licensor provides the Licensee with a crop of grass for a fee, but the Licensor remains the occupier of the land for purposes of claiming BPS. They will need to be in occupation themselves for at least 28 days each year
What is a Grazing Licence?
Short term licence where grazier does not have exclusive possession. The Licensor grants the Licensee the right to use the land for a period of time, but must return the land upon expiry. Up to 364 days per year.
