What is the key issue with leaseas and multiple occupants?

A

If the occupiers together have a right to exclude all others, then there is a lease

But question is if they have one joint lease or several individual leases

A

all must be entitled to occupy the whole of the premises

no one has exclusive use of any part

if occupier can show that they each have exclusive possession of a part of property then it is possible for them to have individual leases of their own part

A

the same term

under the same conditions and

must be jointly liable for the rent
