A
  1. Exclusive posession - The tenant must have exclusive possession of the property, meaning they have the right to exclude others from the premises, including the landlord himself.
  2. There must be a fixed term, a period of time that the tenancy exists for. E.g., Six months, a year etc.
  3. Rent, there must be a form of rent paid to the landlord in exchange for the property. The rent can be subjective.

What are the characteristics of a license

A
  • Licenses do not create legal relations thus do not have the benefit of statutory protection like leases.
    -Either party can terminate the license on short notice due to limited formality.
