What is an answer? what two things must the D include?

A

An answer is a pleading (unlike a motion which is requesting a court order). You must respond to allegations of complaint, admit, deny, lack of sufficient information and raise affirmative defenses.

A

1) P and D have as a right to amend once, within 21 days after the response/answer.
2) Right with leave of court if justice so requires
3) Variance to match pleadings to evidence (if no objections)
4) Amendment after statute of limitations has run. If relation back to same T/O it can Join as if filed in time.

What are supplemental pleadings?

A

Set forth things that happened after pleadings were filed - right is discretionary.

A

Its lawyer certifying to the best of their knowledge and belief after reasonable inquiry:

1) Paper not for improper purpose
2) Contentions warranted by law
3) Factual contentions and denials have evidentiary support.
