Outline the CONSUMER GUARANTEES ACT 1993

A

The purpose of the CGA is to establish minimum standards for goods and services which are purchased by consumers. It gives remedies against suppliers of goods and services and manufacturers who fail to meet the guaranteed standards.

Explain what is mean by the Acts aim to be complementary

  • Fair Trading Act provides pre‐sale protection by regulating promotional conduct (adverts, brochures, webpage pop‐ups, etc)
  • The Consumer Guarantees Act provides post‐sale protection, i.e. after the sale of goods or provision of services when the consumer has used them.

What guarantees under the Consumer Guarantees Act were breached?

A civil engineer gets a contract for a bridge to cross a wide rural water‐race, which cuts across the driveway to the farmer’s home and garage. The brief stipulates that the bridge must be able to carry domestic cars and motorbikes. Although no time was specified for completion in the contract the farmer felt a year was a long time to wait for the engineering drawings.

The first time the bridge is used by the farmer driving his newSUV over the bridge, the bridge collapses. Initial investigations indicate the bridge failed because it lacked a central pillar which was required because of the width of the water‐race.37
