ANNULMENT
A marriagw that is void and was never legally effective
FEDERAL DIVORCE ACT
Governs divorce
Note: does not deal with property rights. Provincial legislation governs the division of assets and liabilties
UNCONTESTED DIVORCE
Divorce under which both spouses agree to all issues
CONTESTED DIVORCE
Two spouses disagree on the terms of the divorce
COROLLARY RELIEF
A claim for child support, spousal support or custody
JOINT CUSTODY
Two spouses continue to share equally in their responsibilties as parents
ACCESS
Granted to one parent to the children when the other parent has sole custody
NET FAMIYL PROPERTY
Made for each spouse by valuaing property accumulated during the marriage
EQUALIZATION PAYMENT
Spouse with the lower net family property is entitled to an equilization payment from the other spouse
MATRIMONIAL HOME
A residence that is ordinarily occupied by the spouses as a family residence at the time of seperation or divorce
SOLE CUSTODY
Child lives with one parent at least 60% of the time over the course of a year
SPLIT CUSTODY
Each parent has sole custody of one or more of the children
SHARED CUSTODY
Each parent has a child in his/her care for at least 40% of the time over the course of a calendar year
