How does delegated legislation happen?

A

Parliament passes an enabling act which gives the right to create one of the three types of delegated legislation

Orders in council (made by who and what are they?)

A
  • Made by the privy council; made up of the prime minister and other leading members of government
  • Allows government to make laws without going through parliament
  • On matters such as transferring responsibility between government departments
