Right to Title
Main obligation of provincial regulatory bodies is the protection of the right to title. Means graduates of engineering program are not allowed to call themselves engineer without first obtaining the right to do so through registration.
Scope of Practice
Means no one can practice within the exclusive scope of practice of these professions without being licensed. Certain exceptions for related professionals.
Registration
Corporations employing professionals to register 4 years of qualifying experience. Examination on non-technical on law and ethics.
The Obligations of a Professional
Must practice their profession competently and in accordance with the code of ethics of the regulatory body.
Discipline and Enforcement
- Discipline is the process of charging a member and then proceeding to a hearing to determine guilt.
- Enforcement is the process of charging a nonmember with either using the protected professional title in breach of the right to title or practicing the profession in breach of the exclusive scope of practice.
Professional Seals and Letters of Assurance
- Improper use of seal is a disciplinary offence. Used on final drawings, specifications, plans, reports, or other documents prepared and checked by a professional.
- Many governmental authorities require the submission of a letter of assurance at the end of a project. Professionals should determine before starting a project whether a letter of assurance is required. N the Place liability on the professional.
