A

Between every individual and criminal law or victim and tortfeasor or of a consumer or trader(able to use consumer rights act 2015)/buyer or seller
Third parties can also have an interest when subject matter of contract may interest them ie present given but doesn’t work correctly

How does the law address conflicts in contract law

A

By implying terms in contracts between traders and consumers via CRA 2015 (brings together rights and remedies available to consumers, straightforward but not all consumers know rights)

By regulating legal effectiveness of exclusion clauses in contracts not covered by Consumer rights act 2015
(applies to non consumers who fall out scope of CRA ie rental agreement in flats or houses, crackdown of clauses being use as an out, unfair contracts act 1977 and unfair litigation)

The contract rights of third parties act 1999:
(Modified strict rule in Tweddle 1861, but little practical affect as many contracts exclude its effect and no test of reasonableness yet

Judicial creativity in respect to remedies: Jackson 1975 remedy to claimant on own behalf and behalf of family even though Jackson only one party to contract
