what is a statute ?
an act or legislation written by a legal body
what is a public act ?
they change the law for the whole population they become laws when they get royal assent they provide a general power
what is a private member bill?
they are introduced by MPs AND ARE INTRODUCES THROUGH BALLOT SYSTEMS they don’t effect everybody
what is a hybrid bill ?
they are more individually based it will impact the public
what is AR?
actus reus the guilty act the doing part of the offence e.g. conduct - thief
what is MR ?
The guilty mind - the intention at the time the offence
what is strict liability ?
The action if the crimes enough they need no proof
what does the magistrate court deal with ?
petty offences minor assaults traffic offences
what does the crown court do ?
murder rape robbery they have no limit on punishment
what does supreme court do ?
they hear cases of the most importance the outcome could impact the public
what is the literal rule ?
judges should focus strictly on the wording of the law
what is the golden rule ?
you can substitute the law to create a reasonable meaning
what is the purposive rule ?
the purpose of law is to aim to solve problems
what is the mischief rule ?
this asks the judge to think about what is the aim and point in the legislation
