What is the difference between hard law and soft law?
Hard law is regulations and binding rules.
Soft law is non-binding
What is a Regulation?
A binding rule that applies across the EU. It must be done!
What is a directive?
A goal which all countries much achieve but they can devise its own law/way of doing things.
What is a decision?
A rule binding only to those it is addresses to.
What is a recommendation?
A non-binding rule which allows views to be known and suggest a line of action.
What is an opinion?
A non-binding statement.
How many levels of regulatory material do EASA have and what are they?
3 levels.
- Basic Regulation (216/2008)
- Implementing rules
- Soft law
What are basic regulations?
Regulations binding in all elements which have been adopted by the European Parliament.
Who adopts implementing rules?
The European Commission
What are the 3 types of soft law?
- Certification Specifications (CS)
- Acceptable means of compliance (AMC)
- Guidance material (GM)
What is AMC?
Acceptable means of compliance.
Non-binding - illustrate the means to establish compliance.
What is AltMoC?
Alternative Means of Compliance.
Ways to adhere to the rules but with own interpretation. Must demonstrate compliance with the law.
What does Guidance Material do?
Explain the intended purpose of the Regulation and propose examples of good practice.
What is a Derogation?
Allows authority to refrain from adopting certain regulations whilst seeking AMC.
These are time limited.
What is The highest form of EU law?
Commission Regulations (CR)
