Q
If a lessee fails to pay rent, is the landlord entitled to the entire amount that would have become due under the full term of the lease?
A
The doctrine of anticipatory repudiation does not apply in the case of a lease of real property, the owner is not entitled to recovery immediately for the rent that would be due over the full term of the lease. Instead the landlord is only entitled to rental payments as they become due.
