Section 113
General Powers (DIMDFFD)
Direct a person on a road to give NADPOO
Inspect, test, and examine
Move or authorise person to move
Direct to remove a vehicle
Forbid an unlicensed driver
Forbid a transport service
Direct traffic, vehicle, or animal.
Section 114
Power To Stop And Demand Details
Any enforcement officer in/wearing:
- Uniform OR
- Cap/helmet/hat displaying bade of authority OR
- Plain clothes + flashing blue/blue and red lights OR siren
May STOP Vehicle
AND Demand
- NADPOO
- Whether they own the vehicle, if not,
- Name + address of vehicle owner
Section 115
Stickers (POL 555/POL650)
Green Sticker (POL650) – Defective
Fails to comply with regulations or rules
e.g. defective exhaust, tinted windscreen, bald tyre
Pink Sticker (POL555) – Unsafe
Not in a safe condition to be driven on a road
e.g. structural rust, illegal mods, 4 bald tyres
Section 116
Power Of Arrest
If you have GCTS a person has failed to comply with a direction given
under Section 113 or Section 115 of the LTA
Section 118
Obtaining Information
Any officer may require the owner/hirer of any vehicle to give
information within 14 days which may lead to
- Identification and apprehension of a driver OR passenger
IF they have committed any offence against any act
- In a vehicle
Must have been owner/hirer of vehicle at the time
Owner/hirer must have ability to supply
Section 119
Power Of Entry To Carry Out EBT
An officer may enter any premises the person has entered to
complete EBA procedures, without warrant if they have
GCTS that any
- Person fails to stop for flashing lights or siren AND
- Committed reckless or dangerous driving OR
- Driving under the influence of drink/drug or both AND
- Freshly pursuing that person
Section 121
Taking Keys And Forbid Driving
Forbid a person to drive for a specified time
All keys to be surrendered
Render the vehicle immobile
Move or cause a vehicle to be moved
EBA offenders forbidden to drive for 12 hours
Direct a person to drive to a place to rest
Section 121(4) gives you power to arrest if a person
- fails to comply with your directions; or
- attempts to do an act forbidden by Section 121
Section 122
Power To Seize Vehicle For 12 Hours
RGTB that it is in the interest of public safety
Section 123
Power To Seize Vehicle For 10 Days
In order to
- Preserve evidence
- Enable scientific examination
- Establish the cause of a serious traffic accident
RGTB that
- vehicle has been involved in a serious traffic accident or hit
and run OR
- driver failed to stop in accordance with Section 114 (up to 6 months now)
Section 90
Suspension From Driving
If a person has accumulated a total of 100 or more demerits,
their drivers license will be suspended for three months
Section 95
28 Day License Suspension
- BR over 650mcg
- BL over 130mgm
- BR over 400 mcg + convicted within last 4 years
- BL over 80mgm + convicted within last 4 years
- Failed/refused blood test at request of officer/authorised
medical person/hospital
- 40kph over the permanent speed limit
- 50kph over the temporary speed limit
Section 96
Power To Seize Vehicle For 28 Day
- If they were disqualified from holding/obtaining a license
- If they had a suspended/revoked driver license
- Interlock license holder breaches conditions
- Unlicensed + forbidden
- Operated in a race or unnecessary exhibition of speed
- Fail to stop or remain stopped under Section 114
- BR over 400mcg + 2 convictions within last 4 years
- BL over 80mgm + 2 convictions within last 4 years
- Fail/refuse blood test + 2 convictions within last 4 years
