refers to the system used to determine wages and conditions.
wage system was centralised throughout the 1990s, but is now decentralised and the free market determines wage prices with the government setting price floors and conditions
Fair Work Act 2009
allowed for the centralisation of the industrial relations system
allowed for increased efficiency in the provision of labour wages conditions
current system consists of an informal and formal system. the formal system includes collective agreements and awards while the informal system includes common law contracts and return on profits from an incorporated business
National Employment Standards
ten minimum employments that act as a safety net for employees
standards include maximum weekly hours, annual leave, long service leave, public holidays and requests for flexible working arrangements
awards
a legal document that outlines the minimum wages and working condition for all employees in a particular business or industry
enterprise agreements
where pay and conditions are negotiated and decided on between an employer and a union or group of employees. This is then approved by the Fair Work Commission whose job it is to ensure that it passes the BOOT
unfair dismissal
refers to harsh, unjust or unreasonable dismissal of a worker
dispute resolution
collective bargaining
conciliation
arbitration
collective bargaining
a form of negotiation between employers and groups of employees or unions
conciliation
where Fair Work Australia or a third-party act as a mediator and suggest solutions to resolve a dispute
arbitration
where an industrial tribunal sets a legally binding decision on the dispute - this is usually a last resort and can involve further court judgements if escalated
