3 basic assumptions underlying US Labor Relations
1) the adoption and support of a free enterprise (capitalist) system creates an inherent conflict of interest between employers and employees
2) employees in a free and democratic society have a right to independently pursue their employment interests using lawful means
3) collective bargaining provides a process for meaningful employee participation to determine work rules
Knights of Labor (KOL) and International Workers of the World (IWW)
Radical, communist pre-WWII unions. Wanted to drastically change the entire system of capitalism
American Federation of Labor (AFL) - pre-WWII
President: Sam Gompers
Pure and Simple Unionism-didn’t want to revolutionize anything; just wanted their piece of the pie
Represented skilled (craft) workers-shoemakers, house builders, etc. = bargaining power
6 Factors Leading to National Labor Legislation (NLRA) in 1935
1) Industrialization = movement from craft work to mass production
2) low-skilled jobs/ immigrant labor = didn’t need the craft/skilled workers as much. Required level was lowered – less bargaining power in skills
3) Rise of the CIO
4) Economic Depression – 30% unemployment.
5) Change in philosophy from Depression - lead to New Deal
6) F.D.R.’s “New Deal”
paternalism
saw co. as father figure, taking care of employees. Still didn’t like unions, but started thinking about taking care of work “family
closed shop
illegal as of 1947 (Taft-Hartley amendment); can only take application from union members for job at organization
union shop
in unionized organization, have to join union and pay dues within 30 days of being hired
agency shop
don’t have to join union, but still have to pay dues to union after being hired (still receiving benefits even if you aren’t part of the union)
open shop
not required to join union or pay dues
right-to-work
don’t have to join or pay dues, AND union shop and agency shop are illegal
