- Adequate information is necessary to accept or reject proposed treatment
- Person is able to give informed consent either with or without decision support person
- Person is not unduly influenced or pressured by others
capacity vs will and preference
means allowing those deemed to not have the capacity to make a decision that is not in their best interest because it is their will and preference to do so.
