What are the two types of liens
Voluntary and Involuntary Liens
Type of lien that is created by the actions of and with the cooperation of the debtor
Voluntary Lien (ex: mortgages, leases, etc)
Type of lien that is created by a creditor without the cooperation of the debtor
Involuntary Lien (ex: federal, state, private, tax liens, etc)
How does a lien holder enforce a lien?
Through foreclosure or other involuntary sale
Length of time a federal tax lien is good for?
Valid for 10 years and 30 days from the date of assessment
Length of time a federal judgement lien is good for?
Valid for 20 years and is renewable
Length of time a private judgement lien is good for?
Valid for 5 years from the date of the judgement or date of issuance of the last execution (whichever is later)
Length of time a mechanics lien is good for?
6 years from the date of judgement (this is considered a private lien but is the exception to the standard 5 years for private)
Length of time a State of Ohio Judgement is good for?
Valid for 15 years from the date of issuance
