Children in Need of Assistance

Restitution
Youth and/or their parents; up to $10,000 for each event. The DJS collects payments when the restitution order provides that restitution be made in installment payments as part of probation, or under a work plan.
Pre-disposition plan or report
a presentence investigation that includes the social history of the juvenile prepared by a probation officer.
Discretionary waiver
any youth age 15 and older for any alleged offense, or for youth not yet 15 but alleged to have committed a crime which, if committed by an adult, would be punishable by life imprisonment
Statutory Exclusion
the crime and age of offender decide whether case is waived to adult court
youth age 14 and older and alleged to have committed an act which, if committed by an adult, would carry a sentence of life imprisonment, or for youth at least 16 years old and alleged to have committed an enumerated serious felony
Reverse Waiver
waive back to JV Court from adult court due to the “interests of the child or society”

- the age of the child
- the mental and physical condition of the child
- the amenability of the child to treatment in an institution, facility, or program available to delinquent children
- the nature of the child’s acts as proven in the trial or admitted to in a plea entered under Maryland Rule 4-242
- public safety
