justice Flashcards
natural law theory
- from Aristotle
- rules of right and wrong are inherent in people and they’re not created by society or judges
- people who are the most deserving should receive the greater share of resources as it’s unfair to allocate resources to people who don’t work hard
marxism theory
justice should be provided for all and distributed equally regardless of class gender race -bourgeoisie oppress the proletariat so the laws are only for the wealthy
disadvantage of natural law theory
-many people have different ideas as to what is right and wrong so this is subjective when law should be applied equally to everyone
disadvantage of marxism
prosecutions for corporate crime can occur eg white collar crime and not all capitalist societies have high levels of crime eg japan
distributive justice definition and example
justice should be distributed equally regardless of class age gender etc -national minimum age act redistributed income from more wealthy to less
procedure justice definition and example
making an implementing laws and decisions according to a fair process
-jury’s make decision and are allowed to be sympathetic to facts eg R v Ponting but can be seen as not just due to them being influenced by media in a high profile case
corrective justice definition and example
justice focuses on the law providing a fair remedy
-one example is the appeals procedure
